1. Acceptance of Terms

By accessing or using this AI profile photo generation service (the “Service”), you agree to be bound by these Terms of Service. If you do not agree to these Terms, you must not use the Service.

2. Description of the Service

The Service allows users to upload a portrait image and generate AI-created profile photo images in selected styles. Watermarked preview images are provided before payment. Full-resolution, watermark-free images are made available only upon successful payment.

3. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use this Service. By using the Service, you represent that you meet this requirement.

4. User Responsibilities and Warranties

By uploading an image, you represent and warrant that:

  • You own the rights to the image, or you have obtained express permission from the owner to use and submit it.
  • You have obtained consent from any identifiable person in the image.
  • The image does not infringe the intellectual property, privacy, or publicity rights of any third party.
  • You must not upload illegal, abusive, defamatory, or pornographic content.
  • We reserve the right to refuse service or remove content that violates these Terms.
  • Prohibited Content: You strictly agree not to upload, generate, or attempt to generate any content that:
    • Is sexually explicit, pornographic, or of an adult nature.
    • Depicts violence, self-harm, or illegal acts.
    • Is intended to harass, defame, bully, or threaten any individual.
    • Includes "Deepfakes" or non-consensual sexual imagery of any person.
    • Depicts public figures or celebrities without authorization.
  • System Refusal: You acknowledge that our third-party AI processors (Google Gemini) employ automated safety filters. If your upload is flagged as "Prohibited Content," the Service may automatically refuse to process the image.
  • No Refunds for Violations: We reserve the right to terminate access to the Service without a refund if we determine, in our sole discretion, that you have violated these content standards.

5. AI-Generated Content

Images generated through the Service are created by artificial intelligence. You acknowledge that:

  • Results are probabilistic; we do not guarantee a specific artistic outcome or a perfect likeness.
  • AI-generated images may contain technical inconsistencies or “artifacts.”
  • The Service is provided “as is” regarding the artistic quality of the output.

6. Intellectual Property

  • User Input: You retain all ownership rights to the images you upload.
  • Generated Output: Subject to full payment of the applicable fees, we hereby assign to you all right, title, and interest in the final, full-resolution generated image for your personal and professional use.
  • System Usage: We reserve the right to use anonymized, non-identifiable technical data to maintain and improve the Service.

7. Payment and No-Refund Policy

  • Fees: A flat fee is charged for access to full-resolution images. All prices are displayed at checkout.
  • Refunds: Except as required by mandatory local consumer laws (such as the Australian Consumer Law or EU Consumer Rights Directive), all sales are final. Since a watermarked preview is provided for your inspection prior to purchase, refunds will not be issued for "change of mind" or dissatisfaction with the AI’s artistic style.

8. Image Retention and Deletion

  • Uploaded Images: Your original uploaded image is deleted from our servers immediately after the AI generation process is complete.
  • Generated Images: Generated images are stored for 30 days after purchase to allow for download. After 30 days, these images are permanently deleted.

9. Indemnity

You agree to indemnify, defend, and hold harmless the Service and its operators from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your breach of these Terms or your violation of any third-party rights.

10. Third-Party AI & Google Gemini Disclosure

The Service utilizes the Google Gemini API for image generation.

  • Your images are transmitted to Google for processing.
  • We utilize enterprise-grade API configurations to ensure that your uploaded images are processed solely to fulfill your request and are not used by Google to train its foundational AI models.

11. Third-Party Payment Processing

Payments are processed by third-party providers (e.g., Stripe). We do not store your credit card details. Your financial data is handled in accordance with the provider’s own security and privacy policies.

12. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount paid by you for the specific transaction in question.

13. Service Availability

We do not guarantee uninterrupted or error-free access to the Service. We may suspend, modify, or discontinue the Service at any time without notice for maintenance or updates.

14. Governing Law

These Terms are governed by the laws of Victoria, Australia, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in that jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. Your continued use of the Service after changes are published constitutes your acceptance of the revised Terms.
